1. About These Terms

These Terms & Conditions ("Terms") form a binding agreement between you ("you" or "User") and Precision Funding LLC ("Precision Funding," "we," "us," or "our"). By accessing or using our Services — including NQ Sim Challenge, Funded Same Day challenges, and any other product offered at precisionfunding.vip — you agree to these Terms, our Privacy Policy, Risk Disclaimer, and Sim Challenge Rules.

2. Nature of Services

• NQ Sim Challenge: a simulated market prediction product where users predict directional moves on publicly-traded markets (Bitcoin, Solana, NASDAQ futures) within a simulated environment. It is a simulated prop-firm style product, not gambling, not a casino, not investment advice.
• Funded Same Day: simulated trading challenges using third-party platforms (e.g., Rithmic R Trader Pro). Successful challenge completion may qualify participants for profit-share payouts under specific terms.
• Outcomes are determined by objective market data sourced from established exchanges; not by Precision Funding.

3. Eligibility

• You must be at least 18 years of age.
• Services are not available to residents of Washington, Idaho, or Michigan, or any jurisdiction where prohibited by law. See Jurisdictional Restrictions.
• By creating an account, you represent that participation is legal in your location and that you are not on any government sanctions or restricted-persons list.
• Employees, officers, and immediate family members of Precision Funding LLC are not eligible for payouts.

4. Balances (NQ Sim Challenge)

NQ Sim Challenge uses two account balances:

• Sim Balance: simulated evaluation capital. It may be purchased at a flat rate of $1 = 10 SIM (no bonuses or tiers) and may also be granted in small free daily claims. It is used only for predictions in the Sim Challenge, has no independent cash value, and is not withdrawable.
• Payout Balance: approved US-dollar payout value. It cannot be purchased, deposited into, or used for predictions. It is created only when Precision Funding approves an eligible payout request under the published evaluation rules.

The current baseline, performance target, activity minimum, risk limit, and reset treatment are published in the SIM Evaluation Rules.

5. Sim Challenge Mechanics (NQ Sim Challenge)

• Each round opens with a brief countdown timer for participants to submit LONG or SHORT predictions.
• At lock time, the current live market price becomes the entry price for that round.
• Take-Profit and Stop-Loss distances are set per market and disclosed in the round UI.
• Correct predictions return 2x the entry amount in Sim Balance. Incorrect predictions result in loss of the entry amount.
• If neither side hits Take-Profit before both Stop-Loss prices are crossed, the round ends as a tie and all entries are forfeited.
• Rounds may be voided in case of data feed errors or technical issues; entries are refunded in such cases.
• Every completed prediction contributes to a verified evaluation record. Eligibility is based on a completed cycle, not a single prediction.
• Under the current rules, a cycle must reach 4x the cycle’s lowest balance, include at least 20 settled predictions and settled activity equal to at least 1x the baseline, and keep each prediction at or below 10% of the starting baseline.
• There is no minimum number of trading days. The first eligible $500 payout tranche may be submitted for same-day review; all payout requests remain subject to review and approval.

6. Funded Same Day Trading Challenges

• Challenges are conducted on simulated trading accounts using third-party platforms.
• Participants must adhere to the specific rules of their selected challenge tier, including profit targets and drawdown limits.
• Violation of challenge rules may result in challenge account closure. Challenge fees are non-refundable except where required by law.
• Successful challenge completion may qualify the participant for profit-share payouts on subsequent simulated profits.
• All trading approaches (scalping, news trading, etc.) are generally permitted unless explicitly excluded for a given challenge tier.

7. Payouts

• Eligible evaluation profit may be submitted for payout review at the rate displayed in the product. Meeting the objective makes a request eligible for review; it does not guarantee approval.
• Approved value is credited to Payout Balance and may then be submitted for withdrawal using the available methods.
• Funded Same Day profit-share payouts are processed under the rules of the respective challenge.
• Withdrawals are available via supported methods: Wire transfer, Zelle, cryptocurrency, or PayPal.
• We aim to review the first eligible $500 payout tranche the same business day. Larger amounts, later requests, identity review, banking processes, weekends, holidays, and compliance checks may require additional time.
• Identity verification (KYC) is required before processing payouts, particularly for first-time payouts or larger amounts.

8. Identity Verification, AML, & Tax

• To comply with applicable laws including Anti-Money Laundering ("AML") and Know-Your-Customer ("KYC") obligations, we may require identity verification documents (government ID, selfie, proof of address).
• Tax forms (W-9 / W-8BEN) may be required for payouts exceeding reporting thresholds.
• All taxes on payouts are the sole responsibility of the recipient.
• We may issue Form 1099-MISC or other tax forms as required by law.

9. Account Conduct

• You are responsible for maintaining the confidentiality of your account credentials.
• One account per person. Multiple accounts may result in account closure.
• You agree not to use bots, scripts, scraping tools, or any automation to interact with the Services without our written permission.
• Fraudulent activity (chargebacks without cause, identity fraud, promotional abuse, multiple accounts, or attempts to manipulate evaluation baselines) may result in account restriction, denial of affected payout requests, or account closure, subject to the published rules and applicable law.
• Abusive behavior in community chat is prohibited and may result in chat bans or account closure.

10. Responsible Participation

We treat NQ Sim Challenge and Funded Same Day as simulated products. We encourage participants to engage at levels they are comfortable with. If you would like to take a break from the platform or close your account, contact us at support@precisionfunding.vip and we will accommodate cooling-off periods and self-exclusion requests.

11. Limitation of Liability

To the maximum extent permitted by law, Precision Funding shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the Services. Our total liability for any claim related to the Services is limited to the greater of (a) the total amount you paid us in the twelve months preceding the claim, or (b) one hundred US dollars ($100).

The Services are provided "as is" without warranties of any kind. Market data is provided by third parties; we are not liable for delays, inaccuracies, or interruptions in third-party data feeds.

12. Indemnification

You agree to indemnify and hold harmless Precision Funding and its officers, directors, employees, and agents from any claims arising out of your use of the Services, your violation of these Terms, your violation of any third-party rights, or your violation of applicable law.

13. Dispute Resolution & Arbitration

Please read this section carefully — it affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. Arbitration shall take place in Delaware, USA, or remotely if mutually agreed. The arbitrator's decision is final and binding.

Class action waiver: you and Precision Funding agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action.

Exception: small-claims court actions and intellectual property disputes may be brought in any court of competent jurisdiction.

14. Intellectual Property

All content on the Services — text, graphics, logos, software, the AI host persona, and other materials — is owned by Precision Funding or its licensors and protected by US and international intellectual property laws. You may not copy, distribute, modify, or create derivative works without our written permission.

15. Account Closure & Termination

You may close your account at any time by contacting support. We may suspend or close accounts that violate these Terms, with notice where reasonably possible. If an account is closed for cause, affected Payout Balance and pending payout claims may be withheld or denied only as permitted by the published rules and applicable law.

Inactive accounts (no login or activity for 24 consecutive months) may be archived; we will email you before any action that affects your balance.

16. Affiliate Program Terms

• Approved affiliates earn a base revenue share (currently 12% on NQ Sim Challenge activity, custom rates available for Funded Same Day partnerships) on net revenue generated from referred users.
• Net Revenue is defined as gross revenue from referred users minus payouts paid, refunds, chargebacks, bonuses, and applicable processing fees.
• Commissions are paid on a regular schedule per the Affiliate Dashboard. Identity / tax documentation may be required before payouts.
• Fraudulent activity (self-referrals, fake signups, incentive abuse, violations of FTC disclosure rules) results in immediate program termination and forfeiture of accrued commissions.
• The Affiliate Program is governed by these Terms plus the full Affiliate Agreement.

17. Governing Law & Amendments

These Terms are governed by the laws of Delaware, USA, without regard to conflict of law principles. We may modify these Terms from time to time. Material changes will be communicated via email or platform notice. Continued use of the Services after changes constitutes acceptance.
