1. About These Terms

These Terms & Conditions ("Terms") form a binding agreement between you ("you" or "User") and Precision Funding LLC ("Precision Funding," "we," "us," or "our"). By accessing or using our Services — including NQ SweepX, Funded Same Day challenges, and any other product offered at precisionfunding.vip — you agree to these Terms, our Privacy Policy, Risk Disclaimer, and Official Contest Rules.

2. Nature of Services

• NQ SweepX: a sweepstakes prediction contest where users predict directional moves on publicly-traded markets (Bitcoin, Solana, NASDAQ futures). Operates under US sweepstakes promotion law. Not gambling, not a casino, not investment advice.
• Funded Same Day: simulated trading challenges using third-party platforms (e.g., Rithmic R Trader Pro). Successful challenge completion may qualify participants for profit-share payouts under specific terms.
• Outcomes are determined by objective market data sourced from established exchanges; not by Precision Funding.

3. Eligibility

• You must be at least 18 years of age.
• Services are not available to residents of Washington, Idaho, or Michigan, or any jurisdiction where prohibited by law. See Jurisdictional Restrictions.
• By creating an account, you represent that participation is legal in your location and that you are not on any government sanctions or restricted-persons list.
• Employees, officers, and immediate family members of Precision Funding LLC are not eligible for cash prizes or payouts.

4. Currencies (NQ SweepX)

NQ SweepX uses two virtual currencies, required by sweepstakes law:

• Gold Coins (GC): entertainment-only play credits. Purchased optionally. No cash value. Not redeemable. Used for practice play.
• Sweep Coins (SC): sweepstakes entries. Awarded as free promotional bonuses with Gold Coin purchases, through daily login bonuses, through chat participation, or via the no-purchase-necessary mail-in method (see Free Entry Policy). Sweep Coins cannot be purchased directly. Sweep Coin prizes may be redeemed at published prize tiers for cash payouts.

5. Contest Mechanics (NQ SweepX)

• Each contest round opens with a brief countdown timer for participants to submit LONG or SHORT predictions.
• At lock time, the current live market price becomes the entry price for that round.
• Take-Profit and Stop-Loss distances are set per market and disclosed in the round UI.
• Correct predictions return 2x the entry amount in the same currency. Incorrect predictions result in loss of the entry amount.
• If neither side hits Take-Profit before both Stop-Loss prices are crossed, the round ends as a tie and all entries are forfeited.
• Rounds may be voided in case of data feed errors or technical issues; entries are refunded in such cases.

6. Funded Same Day Trading Challenges

• Challenges are conducted on simulated trading accounts using third-party platforms.
• Participants must adhere to the specific rules of their selected challenge tier, including profit targets and drawdown limits.
• Violation of challenge rules may result in challenge account closure. Challenge fees are non-refundable except where required by law.
• Successful challenge completion may qualify the participant for profit-share payouts on subsequent simulated profits.
• All trading approaches (scalping, news trading, etc.) are generally permitted unless explicitly excluded for a given challenge tier.

7. Prize Redemption & Payouts

• Sweep Coin prizes may be redeemed for cash at published tiers (see the Cash Out page).
• Redeemed prize value is credited to your withdrawable balance after redemption approval.
• Funded Same Day profit-share payouts are processed under the rules of the respective challenge.
• Withdrawals are available via supported methods: Wire transfer, Zelle, cryptocurrency, or PayPal.
• Most withdrawals are processed the same business day per our Same-Day Payout™ policy; some methods may take additional time due to banking processes.
• Identity verification (KYC) is required before processing redemptions, particularly for first-time redemptions or larger amounts.

8. Identity Verification, AML, & Tax

• To comply with applicable laws including Anti-Money Laundering ("AML") and Know-Your-Customer ("KYC") obligations, we may require identity verification documents (government ID, selfie, proof of address).
• Tax forms (W-9 / W-8BEN) may be required for redemptions exceeding reporting thresholds.
• All taxes on prizes and payouts are the sole responsibility of the recipient.
• We may issue Form 1099-MISC or other tax forms as required by law.

9. Account Conduct

• You are responsible for maintaining the confidentiality of your account credentials.
• One account per person. Multiple accounts may result in account closure.
• You agree not to use bots, scripts, scraping tools, or any automation to interact with the Services without our written permission.
• Fraudulent activity (chargebacks without cause, identity fraud, promotional abuse, multiple accounts) may result in account closure and forfeiture of unredeemed Sweep Coins and pending prizes.
• Abusive behavior in community chat is prohibited and may result in chat bans or account closure.

10. Responsible Participation

We treat NQ SweepX and Funded Same Day as entertainment products. We encourage participants to engage at levels they are comfortable with. If you would like to take a break from the platform or close your account, contact us at support@precisionfunding.vip and we will accommodate cooling-off periods and self-exclusion requests.

11. Limitation of Liability

To the maximum extent permitted by law, Precision Funding shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the Services. Our total liability for any claim related to the Services is limited to the greater of (a) the total amount you paid us in the twelve months preceding the claim, or (b) one hundred US dollars ($100).

The Services are provided "as is" without warranties of any kind. Market data is provided by third parties; we are not liable for delays, inaccuracies, or interruptions in third-party data feeds.

12. Indemnification

You agree to indemnify and hold harmless Precision Funding and its officers, directors, employees, and agents from any claims arising out of your use of the Services, your violation of these Terms, your violation of any third-party rights, or your violation of applicable law.

13. Dispute Resolution & Arbitration

Please read this section carefully — it affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. Arbitration shall take place in Delaware, USA, or remotely if mutually agreed. The arbitrator's decision is final and binding.

Class action waiver: you and Precision Funding agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action.

Exception: small-claims court actions and intellectual property disputes may be brought in any court of competent jurisdiction.

14. Intellectual Property

All content on the Services — text, graphics, logos, software, the AI host persona, and other materials — is owned by Precision Funding or its licensors and protected by US and international intellectual property laws. You may not copy, distribute, modify, or create derivative works without our written permission.

15. Account Closure & Termination

You may close your account at any time by contacting support. We may suspend or close accounts that violate these Terms, with notice where reasonably possible. If an account is closed for cause, unredeemed Sweep Coins and pending prize claims may be forfeited, subject to applicable law and our compliance obligations.

Inactive accounts (no login or activity for 24 consecutive months) may be archived; we will email you before any action that affects your balance.

16. Affiliate Program Terms

• Approved affiliates earn a base revenue share (currently 12% on NQ SweepX activity, custom rates available for Funded Same Day partnerships) on net revenue generated from referred users.
• Net Revenue is defined as gross revenue from referred users minus prizes paid, refunds, chargebacks, bonuses, and applicable processing fees.
• Commissions are paid on a regular schedule per the Affiliate Dashboard. Identity / tax documentation may be required before payouts.
• Fraudulent activity (self-referrals, fake signups, incentive abuse, violations of FTC disclosure rules) results in immediate program termination and forfeiture of accrued commissions.
• The Affiliate Program is governed by these Terms plus the full Affiliate Agreement.

17. Governing Law & Amendments

These Terms are governed by the laws of Delaware, USA, without regard to conflict of law principles. We may modify these Terms from time to time. Material changes will be communicated via email or platform notice. Continued use of the Services after changes constitutes acceptance.
